By downloading, accessing, or using the Availio mobile and web application ("Platform"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Platform. These Terms constitute a legally binding agreement between you and Availio (the "Company"), a platform operating under the laws of the Republic of the Philippines.
You must be at least 18 years old and legally capable of entering into binding contracts under Philippine law to use Availio. By registering, you represent and warrant that: (a) all information you provide is accurate, current, and complete; (b) you will maintain and update your information as necessary; (c) you will not create an account on behalf of another person without their explicit consent; and (d) your account is for personal or legitimate business use only. Availio reserves the right to suspend or terminate accounts found to be inaccurate, fraudulent, or in violation of these Terms.
Availio is a technology marketplace platform that connects vehicle and equipment owners ("Providers") with individuals seeking to rent ("Renters"). Availio is not a party to any rental agreement formed between Providers and Renters. Availio does not own, operate, manage, or control any listed vehicles or equipment. All rental contracts are directly between the Provider and the Renter. Availio facilitates discovery, booking, and payment processing but assumes no responsibility for the performance of either party.
Providers must: (a) be the lawful owner or authorized representative of any listed vehicle or equipment; (b) ensure all listings are accurate, including photos, specifications, pricing, and availability; (c) maintain their vehicles in safe, roadworthy, and legally registered condition at all times; (d) complete identity and business verification as required by Availio; (e) maintain a minimum wallet balance of ₱100 to accept bookings; (f) honor confirmed bookings unless an emergency or force majeure event applies; and (g) comply with all applicable laws, including LTO regulations, local ordinances, and tax obligations. Providers agree that Availio may deduct platform commissions from their wallet balance upon booking completion.
Renters must: (a) possess a valid driver's license appropriate for the vehicle category being rented; (b) provide accurate personal and contact information; (c) use rented vehicles only for lawful purposes and in accordance with the Provider's stated policies; (d) return vehicles on time and in the same condition as received, subject to normal wear; (e) pay all agreed rental fees, security deposits, and any additional charges for damages, late returns, or policy violations; and (f) not sublease, lend, or transfer the rented vehicle to any third party. Renters are solely responsible for any traffic violations, fines, or legal incidents occurring during the rental period.
Bookings are confirmed upon acceptance by the Provider. Payment terms (GCash, bank transfer, cash) are agreed upon at checkout and must be completed as specified. Security deposits, where applicable, are collected by the Provider directly and are refundable at the Provider's discretion based on the vehicle's return condition. Availio does not hold or process security deposits on behalf of either party. Availio charges a platform commission to the Provider upon each completed booking, deducted automatically from the Provider's wallet.
Cancellation and refund policies are set individually by each Provider and are displayed on the listing page. Renters are encouraged to review these policies before booking. Availio does not guarantee refunds unless the Provider's stated policy explicitly provides for one. In cases of Provider cancellation, Availio will make reasonable efforts to assist the Renter in finding an alternative but bears no financial liability. Disputes regarding refunds must first be raised with the Provider; if unresolved, Availio may mediate at its sole discretion but is not obligated to provide refunds from its own funds.
You agree not to: (a) provide false, misleading, or fraudulent information on any listing, booking, or profile; (b) use rented vehicles for illegal activities, racing, or purposes not permitted by the Provider; (c) manipulate ratings or reviews; (d) harass, threaten, or abuse other users; (e) circumvent the platform by conducting transactions off-platform to avoid fees; (f) use automated bots or scrapers on the Platform; (g) infringe on the intellectual property rights of Availio or third parties; or (h) engage in any activity that disrupts or damages the Platform's operations. Violations may result in immediate account suspension, termination, and referral to appropriate legal authorities.
Renters are fully liable for any damage to rented vehicles or equipment occurring during the rental period, beyond normal wear and tear. Availio strongly recommends that Renters confirm insurance coverage before renting. Providers are responsible for ensuring their vehicles comply with Philippine insurance requirements under R.A. 10607 (Insurance Code). Availio does not provide insurance coverage for any vehicle, equipment, person, or property. Any insurance claims must be handled directly between the parties and their respective insurers.
To the maximum extent permitted by Philippine law, Availio and its officers, employees, and affiliates shall not be liable for: (a) any indirect, incidental, special, consequential, or punitive damages; (b) loss of life, personal injury, or property damage arising from use of a rented vehicle; (c) actions or omissions of Providers or Renters; (d) inaccuracies in listings; (e) delays, cancellations, or service interruptions; or (f) unauthorized access to your account due to your own negligence. Availio's total aggregate liability to you for any claim shall not exceed the total platform fees paid by you in the three (3) months preceding the claim.
All content, trademarks, logos, software, and technology on the Availio Platform are the exclusive property of Availio or its licensors and are protected under Philippine intellectual property laws (R.A. 8293). You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes. You may not copy, reproduce, distribute, modify, or create derivative works of any Platform content without prior written consent from Availio.
Hosts may report a Renter to the shared Blocklist, which requires the Renter's name, email, mobile number, a photograph of the Renter and a photograph of their valid ID. By submitting a report you warrant that: (a) the incident you describe actually occurred and you can substantiate it; (b) the photographs you upload were lawfully obtained in the course of the rental; and (c) you are not submitting the report maliciously, as retaliation, or to gain competitive advantage. Blocklist data may be used ONLY to verify the identity of a prospective Renter. You must not download, copy, publish, post to social media, or share Blocklist data — including photographs and ID images — with anyone outside the Availio platform. Renters may dispute any entry, and Availio administrators may remove an entry at their discretion following review. Submitting false, defamatory, or unsubstantiated reports, or misusing Blocklist data, is a material breach of these Terms and may result in immediate suspension or termination of your Host account, and may expose you to civil or criminal liability under Philippine law, including R.A. 10173 (Data Privacy Act) and the Revised Penal Code provisions on libel. Availio does not verify Blocklist reports and is not liable for their accuracy; responsibility rests with the reporting Host.
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the appropriate courts of Cebu City, Philippines, which shall have exclusive jurisdiction, or to mediation/arbitration as may be agreed upon by both parties.
Availio reserves the right to modify these Terms at any time. We will notify users of material changes via in-app notification or email at least 7 days before the changes take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Platform and may request account deletion.
